Work permits are issued for a set time period, to remain in Canada and extend employment passed the expiry date on the initial work permit, an application for work permit extension can be submitted provided that the work permit is still valid.
The employer still needs to fulfill its LMIA requirements for the worker’s extension to be approved.
It’s important to submit an application for extension of a work permit before the work permit expiry date.
- For applications online they must be submitted before midnight
- For paper applications mailed, the date the application is received is used to determine whether the application was timely or not, with a 7 days of leeway.
If your work permit expires while your application for an extension is still processing, because you’ve taken the necessary steps to maintain your status in Canada as a worker, you are legally authorized to continue working in Canada until a decision is made on your work permit extension application.
Work Permit Restoration
If the worker has a work permit that is already expired, they must apply for a restoration instead, this process involves obtaining a new work permit. This is an application to restore status as a worker. This application must be done within 90 days of the work permit expiring.
Generally you’re not able to work until the application to restore status as a worker has been approved.
